Pennsylvania cop on trial for allegedly murdering girlfriend’s estranged husband

Tuesday, March 10, 2009

The trial began today for a Pennsylvania state trooper accused of killing his girlfriend’s estranged husband.

Kevin Foley, 43, is accused of cutting the throat of John Yelenic, a dentist who was in the final stages of finalizing a divorce from his wife, Michele. According to prosecutors, Foley “loathed Dr. Yelenic” so much that he asked another fellow trooper to help him commit the alleged murder, which occurred in Yelenic’s Blairsville home.

Deputy Attorney General Anthony Krastek told an Indiana County jury that Foley also prayed Yelenic would die, and spread false rumors that Yelenic molested his adopted son.

“You will see Kevin Foley has the motive, the opportunity and the ability to commit this crime, almost to the exclusion of anybody else,” Krastek said.

Foley’s defense attorney, Jeffrey Monzo, said during opening statements that DNA evidence was not conclusive. Monzo admitted to the jury that Foley did not like Yelenic, but said that does not mean he murdered him.

“Kevin Foley is innocent,” he said.

Prosecutors said they could call as many as 70 witnesses to try and prove Foley wanted Yelenic to die. The trial, at the Indiana County Courthouse, is expected to last about three weeks.

Foley, who is on unpaid suspension from the Pennsylvania State Police, is charged with criminal homicide. The jury has the option of convicting him of first-degree murder, which could put Foley in prison for life without parole, or of a lesser degree charge, like manslaughter.

John Yelenic was found dead in his home on April 13, 2006, one day before he was planning on signing his divorce papers. Prosecutors said Foley killed Yelenic after going to the dentist’s house to confront him over the terms of the divorce. Prosecutors claim Foley slashed Yelenic several times with a knife and pushed his head through a small window, causing a further gash on his neck. Yelenic bled to death.

Foley had been living with Michele Yelenic for two years at the time of the alleged homicide. Krastek said Michele also helped perpetuate rumors that Dr. Yelenic molested their son. John and Michele Yelenic had been separated in 2002. Michele Yelenic stood to collect Dr. Yelenic’s estate and a $1 million life insurance policy, and could lose about $2,500 a month in support if the divorce was finalized, a Pennsylvania grand jury previously determined.

Michele Yelenic is expected to testify that Foley was home with her when the alleged murder occurred. Krastek told the jury DNA under Yelenic’s fingerprints will ultimately link him to the murder, as will bloody shoe prints found at the crime scene that match athletic shoes Foley is known to wear.

Monzo also said authorities have failed to investigate several other suspects, including Yelenic’s neighbor. Monzo said Yelenic was on very friendly terms with the neighbor’s wife, which could have given him a motive to commit the murder.

Prior to the trial, Foley’s defense attorneys unsuccessfully sought a change of venue because an overwhelming majority of the jury pool was familiar with the allegations. The change was denied when jurors insisted they had not formed an opinion about the charges.

Interview with Reggie Bibbs on his life with neurofibromatosis

Friday, December 14, 2007

Neurofibromatosis (NF) is a genetic condition causing benign tumors (neurofibromas) to grow along certain types of nerves and, in addition, it can affect the development of bones or skin. There are several variants of the disease but type 1 and type 2 NF account for the vast majority of cases.

The disease manifestations can vary from very mild to severe. Major symptoms include growths on and under the skin; skin pigmentations called café au lait spots in type 1; acoustic nerve tumors and consequent hearing loss in type 2. Growths can affect nearly all parts of the body, and pressure on nearby structures can cause a wide variety of complications. There is a small risk that the tumors transform into malignant cancerous lesions.

NF is one of the most common single-gene human diseases; around 1 in 2,500-4,000 live births are affected by NF-1, whereas NF-2 occurs in about 1 in 50,000-120,000. Both type 1 and 2 are autosomal dominant conditions, meaning that only one copy of the mutated gene need be inherited to pass the disorder. A child of a parent with neurofibromatosis and an unaffected parent will have a 50% chance of inheriting the disorder. The gene responsible for NF-1 and possibly NF-2 is thought to function as a tumor suppressor gene.

In most cases of neurofibromatosis 1, patients can live normal and productive lives. In about 25-40% of patients there is an associated learning disability with or without ADHD. In some cases of neurofibromatosis 2, the damage to nearby vital structures, such as the cranial nerves and the brainstem, can be life-threatening. When tumors are causing pain or disfiguration, surgery is thus far the only proven beneficial treatment option.

Reggie Bibbs is a 43-year-old-man living in Houston, Texas. Mr Bibbs was born with a genetic disease called neurofibromatosis (NF), which causes him to develop tumors on his body (see infobox on the right). NF can be a subtle disease, but in Bibbs’ case it has left him with a disfigured face and deformed leg. But he is happy with the way he looks, and doesn’t want to change his appearance to please other people. He has launched a successful campaign entitled “Just Ask”, and that’s just what Wikinews did in a video-interview.

The interview was prepared by Wikinews reporter Michaël Laurent with the help of Bertalan Meskó (who has a popular genetics and web 2.0 blog). Their questions were sent to a close friend of Mr. Bibbs, Lou Congelio, who kindly conducted the interview.

More troops for southern Thailand troubles

Sunday, October 9, 2005

The Thai Prime Minister, Thaksin Shinawatra, despatched an additional 1,000 troops to the south of the country to help deal with the widespread violence. This brings the total number of security forces operating in the three troubled provinces to approximately 30,000.

Mr. Shinawatra’s recent visit to the region was followed by further shootings. In Narathiwat Province a 40 year old village worker was shot while helping a neighbour repair a fence. Friday saw the shooting of an assistant village head in Yala Province, and an elderly couple were shot in Pattani Province whilst returning from a local market.

The insurgency and campaign for an independent Muslim state in the southern provinces has resulted in an exodus from the area. Estimates put the number of Thai Buddhists who have fled the area at 34,000. There are also some reports that Muslim inhabitants of the area have been seeking refuge in Malaysia.

The state of emergency imposed last month has had a mixed reception. Largely favoured by Buddhists in the provinces, this grants additional powers to the Prime Minister and follows on from martial law having been in place since January 2004. Despite these security measures, over 1,000 people have died in the insurgency.

2010 Komen St. Louis Race for the Cure becomes world’s largest Komen race

Saturday, June 12, 2010

The Race for the Cure logo

The 2010 Susan G. Komen St. Louis Race for the Cure, held earlier today in St. Louis, Missouri, became the world’s largest Race for the Cure, with over 71,000 participants.

2010 marks the twelfth year for the race in St. Louis, which raises money for breast cancer research nationwide. Originally brought to the city in 1999, it has raised over US$19 million. It was sponsored by Wells Fargo Advisors, a locally-headquartered brokerage firm of the financial services provider Wells Fargo. Nationally, the Race for the Cure is hosted by Susan G. Komen for the Cure, a non-profit organization supporting breast cancer research.

In 1999, there were only about 10,000 participants in the St. Louis Race for the Cure. In recent years, the number has grown to over 60,000, and today’s 5K race saw over 71,000 runners, walkers, and wheelchair racers. Despite the heat and humidity, 1,090 teams signed up, and over 4,500 breast cancer survivors participated. Overall, the race raised more than US$3.3 million. A phone bank set up by Wells Fargo and local television station KSDK contributed over US$28,000 of that amount in four hours.

Prior to the race, there was a parade of all the breast cancer survivors who had signed up for the race. The actual competition began at 8:30 a.m. CDT (1330 UTC) with the wheelchair race. Following them were the timed runners, the untimed runners, the walkers, and lastly, the “fun walk” participants, who had only opted to walk one mile (1.6 kilometres).

The Komen St. Louis Race for the Cure is only one of many Races for the Cure, which is the largest group of 5K runs and walks in the world. The first Komen race was held in 1983 in Dallas, Texas, but has since spread to over 140 cities throughout the world. Proceeds from today’s St. Louis race will benefit both local institutions and the rest of the United States. At least 25 percent of the money raised will go toward funding national research on breast cancer, while the rest will be given to organizations in St. Louis for breast cancer awareness programs.

Interview with BBC Creative Archive project leader

Thursday, June 22, 2006

Paul Gerhardt, Creative Archive project leader

The Creative Archive project is a BBC led initiative which aims to make archive audio and video footage available to be freely downloaded, distributed, and ‘remixed’. The project is still in a pilot stage, and is only available to UK residents, but the long-term future of the project could have a major impact on the way audiences interact with BBC content.

The project is partly inspired by the Creative Commons movements, and also by a general move within the BBC to be more open with its assets. Additionally, educational audiences such as schools have expressed an interest in using BBC content within the classroom, both to watch and to create multimedia content from.

So far, clips made available under the licence have included archive news footage, nature documentary footage, and video clips content designed for educational uses. “It’s done very well with the audiences we’ve directed them towards – heavy BBC users,” says Paul Gerhardt, project leader. Users downloading the clips are also prompted to fill in a questionnaire, and so far 10-15% of people seem to be doing something with the material, although the BBC can’t be sure what exactly that is.

One of the biggest limitations within the licence as it currently stands during the pilot scheme is that the material is only available for use by people resident in the UK. The BBC’s Creative Archive sites use ‘geo-IP filtering’ to limit downloads to the UK, but there is some confusion over whether people who create their own content using the material can upload their creations to their own websites. A question within the FAQs for one of the more recent selections of clips suggests that this isn’t possible, saying “during this pilot phase material released under the terms of the Creative Archive Licence cannot be used outside the UK – therefore, unless a website has its use restricted to the UK only, content from the ‘Regions on Film’ archive cannot be published on it.”

“We want people to make full use of this content, whether they cut and paste it or whether they share it, and we completely accept that we’ve got a bit of a contradiction at the moment by saying UK-only and yet encouraging people to put it on their sites to share it with others, because you can’t expect people to have geo-IP restriction technology,” admits Mr Gerhardt. “We’re thinking hard about how to deal with this after the pilot – at the moment it’s quite likely that we’re probably going to need to find a distribution partner outside of the UK, so that if you’re outside of the UK you’ve got roughly the same experience as in the UK, but the content could be surrounded by sponsorship messages or advertising or whatever. Once we’ve done that then leakage from one to the other won’t really matter very much.”

The Creative Archive project has not been without critics from the commercial sector, worried that the BBC giving away their content for free would make it difficult for them to be able to make money from their own content. The BBC has explained to some of the commercial players that the content would be limited during the pilot, would not be available in broadcast quality, and that watermarking technologies would be trialled so that content could be recognised when it crops up elsewhere. The BBC is also investigating a business model for the future where there would be a “close relationship between public access to low-resolution content and a click through to monetising that content if you want to buy a high-resolution version”. People who want to play around with the material might discover they have a talent and then find they need to get a commercial license to use it properly, Mr Gerhardt explains, and the project wants to make it easy for this to happen.

Before the project can go ahead with the full scale launch, it will have to go through a ‘public value test’ to assess its overall impact on the marketplace, and commercial media companies will have a chance to input at this point.

For ease in clearing the rights, all of the content available under the pilot project is factual, but in the future the project could include drama and entertainment content. The BBC may also, in the future, work the Creative Archive licences into the commissioning process for new programmes. “This raises some really interesting ideas – if you have a documentary series, you could use the Creative Archive to release the longer form footage, for instance – that would create a digital legacy of that documentary series,” Mr Gerhardt explains. “The other interesting thought in the longer term would be for the BBC, or another broadcaster, to contribute to a digital pool of archive material on a theme, and then invite people to assemble their own content out of that. We could end up broadcasting both the BBC professionally produced programme accompanied by other programmes that other people had made out of the same material.”

One of the ways that the Creative Archive licence differs from the other ‘copyleft’ licences like Creative Commons, aside from the UK-only limitation, is that the licence currently allows the BBC to update and modify the licence, which may worry those using the licence that their rights could suddenly become more restricted. “The licence at the moment is a draft, and we’ve given warning that we may well improve it, but we wouldn’t do that more than once or twice. The ambition is that by the time we scale up to the full service we would have a fixed licence that everyone was comfortable with, and it wouldn’t change after that.”

“The ambition is to think about creating a single portal where people can search and see what stuff is out there under the same licence terms, from a range of different suppliers. The idea is that if we can create something compelling like that, we will attract other archives in the UK to contribute their material, so we’d be aggregating quite a large quantity.”

The Creative Archive project has captured the interest of many Internet users, who are growing increasingly, used the idea of being able to ‘remix’ technologies and content. Some groups have been frustrated with the speed at which the project is developing though, and with some of the restrictions imposed in the licence. An open letter to the BBC urges the dropping of the UK-only limitation, the use of ‘open formats’, and to allow the material to be usable commercially.

Mr Gerhardt has publicly welcomed debate of the licence, but makes it clear to me that the whole BBC archive will never all be available under the Creative Archive terms. “We will make all our archive available, under different terms, over the next five to ten years, at a pace to be determined. There would be three modes in which people access it – some of the content would only be available commercially, for the first five year or so after broadcast, say. The second route is through a ‘view again’ strategy where you can view the programmes, but they’d be DRM-restricted. And the third mode is Creative Archive. Over time, programmes would move from one mode to another, with some programmes going straight to the Creative Archive after broadcast.”

Others who disagree with the ‘UK-only’ restriction within the licence include Suw Charman, from the Open Rights Group, who has said “it doesn’t make sense in a world where information moves between continents in seconds, and where it is difficult for the average user to exclude visitors based on geography.” On the project generally, though, she said “I think that it is a good step along the way to a more open attitude towards content. It is a toe in the water, which is far preferable to the attitude of most of the industry players, who are simply burying their heads in the sand and hoping that lawsuits and lobbying for new legislation will bolster their out-dated business plan.”

Other organisations currently participating in the Creative Archive scheme include the British Film Institute, the Open University and Teachers’ TV. Two artists have been awarded scholarships to create artworks using BBC archive material, and BBC Radio 1 has held a competition asking people to use the footage in creative ways as backing visuals to music. The process of making the BBC’s archive material fully available may be a long one, but it could end up changing the way that people interact with the UK’s public service broadcaster.

byAlma Abell

Many men and women all over the world have a love of the beauty industry, and want to be a part of it. This is why so many people enrol in cosmetology schools. They are able to train to be hair dressers, makeup artists, and manicurists, and when their training is complete, they are ready to begin their careers. Many students opt to take complete cosmetology courses, which will give them training in a number of areas, including hair styling, skin care, nail care, and more.

Anyone who is interested in finding careers at hair salons in Salina must have the proper training. One can’t work as a hair dresser unless they are certified, and have training from an accredited cosmetology school. Students can choose to take comprehensive programs, or specialize in certain areas, such as manicuring.

One of the first questions many people ask is how long it will take to finish their educations and start working in the beauty industry. This actually depends on a few factors. For instance, students who are enrolled in full-time studies are going to graduate much sooner than those who are only attending classes part-time. A full course curriculum requires the most training hours. Students must complete 1,500 to 2,100 training hours in order to be certified in their field. Those who are taking specialized programs, such as nail care, hours of training in Kansas. The required amount of hours is set by the state licensing board.

If a person is taking the full cosmetology program on a full-time basis, they can complete their training within two years. Some specialized programs can be completed within six months. This is something that will need to be discussed with school administrators and instructors. For more information about the various courses offered, enrollment requirements, financial aid, and more, visit www.haysacademy.com. Graduates can immediately begin to look for work at hair salons in Salina, as well as other parts of the State of Kansas.
